Hard Yakka “Reckon you’re a Legend?” Promotion

Terms & Conditions of entry

1. Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.

2. Entry is open only to Australian residents except directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or of the agencies or companies associated with this competition.

3. The competition begins on Monday 9 October 2007 at 9.00am AEDT and closes on Tuesday 31 October 2007 at 9.00pm AEDT. During the Competition Period this promotion will be conducted within every Australian state and territory.

4. The prizes for the Competition are as follows: Hard Yakka pack to the value of $50 (Yakka Cash Sale). There will be one Major Prize winner.

5. To enter the Prize Draw, entrants must click on the ‘Reckon you’re a Legend?’ link at www.yakka.com.au and fill in the online form. Entrants will be required to enter full name, postcode, mobile number, email address and trade/profession.   On doing so entrants will be asked to join the Hard Yakka database. Registration to www.yakka.com.au is free.  An entrant may elect to unsubscribe from this service at any time via the mechanism provided in email newsletters. Entry is only via online.   Entry is only online via www.yakka.com.au Entrants can only enter the promotion once. Entries to the Prize Draw must be received during the Competition Period.  Failure to adhere to the Terms and Conditions set out in the Yakka Privacy Statement regarding publishing content online at www.yakka.com.au will result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid).

7. Error and omissions accepted at the Promoter’s discretion.

8. The Promoter accepts no responsibility for entries that are late, lost, incomplete, incorrectly submitted or otherwise. If the Trade Promotion is dependent on skill or if a Judge's decision is required then the Judge's decision is final and no correspondence will be entered into.

9. The Prize Draw for the major prize will be conducted by Yakka at Yakka Pty Ltd, 26 King William St Broadmeadows VIC 3047 at 9am AEST on Wednesday 1 November 2007.  The most ‘Legendary’ story as determined by the judges will be deemed the winner.

10. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

11. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to prizes.

12. The Major Prize winner will be notified via confirmation email on Wednesday 1 November 2007. The promoter reserves the right to request the winner to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the promoter. If the winner is under the age of 18 years the prize will be awarded to their parent or legal guardian.

13. If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry.  The judges’ decision is final and no correspondence will be entered into.

14. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

15. Prizes are not transferable or exchangeable and cannot be redeemed for cash.  The Promoter accepts no responsibility for any variation in prize value.  Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities in each state and territory, where required.

16. In the event of any of the prizes not being accepted or claimed within three months of the draw, each relevant winners entry will be deemed invalid and the Promoter reserves the right to conduct such further draws on Thursday 31 January at 9am AEDT the same location as the original draw as are necessary to distribute the prizes, subject to any written directions given by any relevant authority.

17. All entries will be the property of the Promoter.  The information entrants provide will be used by the Promoter for the purpose of conducting this competition.  The Promoter -may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition.  By entering the competition entrants are consenting that the Promoter use this information for future promotion and marketing purposes regarding the Promoter’s products, including contacting the entrant via SMS and email. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.  Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
